I guess because you would have to prosecute congress who was fully apprised and approved of all enhanced interrogation methods, including, but not limited to, Nancy Pelosi. If they actually tried to follow through with some sort of ridiculous prosecution, they would end up looking like idiots. Congress had a chance to declare waterboarding illegal via legislation introduced by Ted Kennedy. It was shot down, illustrating two facts: 1) Congress believed it was currently legal, and 2) they wanted to keep it that way.
BTW, do you have a good source for that '83 waterboarding case that isn't a left-wing blog? Post up a link if you can find one.
